Obiettivi formativi
Capacità di applicare gli istituti del procedimento amministrativo e verificare il rispetto delle garanzie procedimentali a favore del cittadino. Capacità di leggere e interpretare i provvedimenti amministrativi e di riconoscere i vizi degli atti amministrativi.
L'insegnamento concorre alla realizzazione dell'obiettivo formativo del Corso di Laurea in Servizio Sociale fornendo le conoscenze giuridiche necessarie a completare il quadro di interdisciplinarietà previsto dallo stesso, quale elemento caratterizzante del percorso di studi.
The aim of the course is: to let the students become capable to apply the rules of the administrative proceedings and to verify their abidance and compliance in order to grant the interests and the rights of the citizens; to read and to interpret administrative decisions and to identify their flaws.
This teaching provides the juridical knowledge which is a fundamental component in a multidisciplinary University Degree such as Social Work.

In particolare il corso mira a realizzare:
1.Conoscenza e capacità di comprensione
L'insegnamento fornisce i fondamenti delle conoscenze in materia di diritto amministrativo, necessarie per orientarsi in determinati settori del Servizio Sociale (funzionamento e organizzazione).
2.Capacità di applicare conoscenza e comprensione
Obiettivo dell'insegnamento è contribuire, nell'ambito del corso di studi in Scienze Sociali, a dotare gli/le student* di un sistema di competenze teoriche professionalizzanti, che gli stessi impareranno ad applicare nell'ambito dei tirocini previsti dal corso.
3.Autonomia di giudizio
L'insegnamento contribuirà a fornire a studenti e studentesse le conoscenze fondamentali per lo sviluppo di una visione critica e di una capacità di analisi dei processi coinvolti nella professione del Servizio Sociale.

L'insegnamento descrive i principi giuridici che individuano le istituzioni pubbliche con definizione della relativa autonomia giuridica; illustra la disciplina dell'attività della pubblica amministrazione, di diritto privato e di diritto pubblico, in particolare degli atti e dei procedimenti amministrativi. Segue la presentazione dell'invalidità degli atti giuridici, della responsabilità civile, penale e amministrativa di funzionari e dipendenti pubblici e delle istituzioni pubbliche d'appartenenza. E' descritta infine la disciplina sull'organizzazione pubblica e sulle relazioni tra istituzioni pubbliche secondo il diritto interno e quello comunitario con particolare riferimento ai servizi pubblici e all'attività di interesse economico generale.

The course describes the legal principles that identify the public institutions, by illustrating the Italian regulation of the public administration, the public law and private law divide and by focusing on the administrative decisions and proceedings. A specific attention is given to the invalidity of administrative decisions, the civil, criminal and administrative liability of officials and civil servants. Finally it describes regulation of the public according to the domestic and the EU law with a focus on the regulations of the public utilities and the general economic interest activities.

Modalità di verifica dell'apprendimento
L’esame si svolgerà in presenza, in forma orale e in lingua italiana.
La valutazione è espressa in trentesimi.
Parametri di valutazione: studenti e studentesse dovranno dimostrare la padronanza delle nozioni apprese e la capacità di effettuare collegamenti e sviluppare ragionamenti secondo il metodo giuridico.
Gli/Le student* erasmus dovranno sostenere l'esame in lingua italiana sul programma indicato nella sezione Programma.
MODALITA' ESONERO (sulla prima parte del programma corrispondente a Parte Prima, Parte Seconda e Parte Terza delle Dispense)
La prova consisterà in tre domande aperte alle quali bisognerà rispondere in forma scritta nel tempo di due ore. A ciascuna risposta verrà assegnato un punteggio da 1 a 10 per un massimo di 30. Il voto attribuito all'esonero farà media con il voto attribuito all'esame orale sulla seconda parte del programma.
Il programma dell’esonero è costituito dalle DISPENSE (Parte Prima, Parte Seconda e Parte Terza) che vengono pubblicate durante il corso nel Materiale Didattico della pagina del corso. Tali DISPENSE SOSTITUISCONO i Capitoli I, II, III, IV e V del manuale E. CASETTA, Compendio di diritto amministrativo, Milano, 2023.
MODALITA’ DELL’ESAME ORALE SUDDIVISIBILE IN DUE PARTI (regole valide per frequentanti e non frequentanti)
Per tutti gli appelli l'esame si svolgerà in forma orale, in presenza.
Ciascun studente e ciascuna studentessa (frequentante e non frequentante) ha la possibilità di suddividere in due parti l’esame orale, anche al di fuori dell’esonero previsto nel mese di novembre. Questo significa che è possibile suddividere l’esame in due parti: in un appello portare il programma corrispondente a quello indicato per l’esonero di novembre (cioè le DISPENSE - Prima, Seconda e Terza Parte - pubblicate nel Materiale Didattico, le quali SOSTITUISCONO i Capitoli I, II, III, IV e V del manuale E. CASETTA, Compendio di diritto amministrativo, Milano, 2023 e in un successivo appello portare la seconda ed ultima parte corrispondente al programma contenuto nei capitoli VI, VII e VIII del manuale E. CASETTA, Compendio di diritto amministrativo, Milano, 2023 (in base alle indicazioni fornite per ciascun Corso di Laurea alla voce Programma (Programma dettagliato) della pagina del corso).
La possibilità di sostenere l'esame in due parti (e quindi in due appelli distinti), suddividendo il programma nelle due parti come sopra indicato, è valida fino all'ultimo appello dell'anno di frequenza del corso, vale a dire fino all'appello di settembre 2024.
E’, ovviamente, necessario per poter sostenere l’esame relativo alla seconda parte del programma aver superato l’esonero o l’appello relativo alla prima parte del programma.
Sia per l’esame riguardante la prima parte di programma che per l’esame riguardante la seconda parte di programma vale la regola per cui NON si potrà considerare superato l’esame se rispetto a ciascuna delle tre domande non si sia ottenuta la sufficienza.

The examination will take exclusively in presence.
The exam is evaluated with a mark expressed in/30.
Evaluation Parameters: the student will demonstrate adequate presentation skills, a proper use of the specific terminology and by showing familiarity with the legal institutes showing adequate lines of reasoning.
Erasmus students will take the exam in italian on the program indicated in the Program section.
MODALITY OF TEST ON FIRST PART OF PROGRAM corresponding to Part One, Part Two and Part Three of the Lecture notes
The test on first part of program will consist of three open questions which will have to be answered in written form within two hours. Each answer will be awarded a score from 1 to 10 for a maximum of 30. The vote assigned to the test on first part of program will average with the vote assigned to the oral exam on the second part of the program.
The first part of program consists of the Lecture notes (Part One, Part Two and Part Three) that are published during the course in the Teaching Material of the course page. These Lecture notes REPLACE Chapters I, II, III, IV and V of the manual E. CASETTA, Compendes of Administrative Law, Milan, 2023.
MODALITY OF THE ORAL EXAM DIVIDED INTO TWO PARTS (rules valid for attending and non-attending students)
For all appeals the exam will take place orally, in presence.
Each student and each student (attending and non-attending) has the opportunity to divide the oral exam into two parts, even outside the exemption provided for in November. This means that it is possible to divide the exam into two parts: in an appeal bring the program corresponding to that indicated for the November exemption (ie the Lecture notes - First, Second and Third Part - published in the Teaching Material, which REPLACE Chapters I, II, III, IV and V of the manual E. CASETTA, Compendium of Administrative Law, Milan, 2023) and in a subsequent appeal bring the second and last part corresponding to the program contained in chapters VI, VII and VIII of the manual E. CASETTA, Compendium of Administrative Law, Milan, 2023 (based on the information provided for each Degree Programme under Programme (Detailed Programme) on the course page).
The possibility of taking the exam in two parts (and therefore in two separate appeals), dividing the program into two parts as indicated above, is valid until the last appeal of the year of attendance of the course, that is until the appeal of September 2024.
It is, of course, necessary in order to be able to take the exam related to the second part of the program to have passed the exemption or the appeal related to the first part of the program.
Both for the examination concerning the first part of the programme and for the examination concerning the second part of the programme, the rule applies whereby the examination will NOT be considered to have passed the examination if, in respect of each of the three questions, the examination has not been obtained.
