Obiettivi formativi
Il corso è inteso a descrivere la genesi e l’evoluzione storica dei diritti dell’uomo nel mondo occidentale, dall’antichità all’età contemporanea, analizzando i mutamenti del significato dei principali diritti fondamentali (quali il diritto alla vita, alla libertà, alla proprietà, all’autodeterminazione) e il loro progressivo estendersi dalla figura del maschio libero e proprietario ad altre categorie sociali (schiavi, popoli colonizzati, donne, minoranze etniche etc.)The course is intended as a description of the historical rise and evolution of the rights of man in the Western world, from the antiquity to the present age. The changes in the meaning of the main fundamental rights (such as the right to life, to freedom, to property, to self-determination), as well as their progressive extension from the figure of the free and owner male to other social categories (slaves, colonized peoples, women, ethnic minorities etc.) will be at the core of the analysis.- Oggetto:

Conoscenza: lo studente apprenderà la specifica terminologia giuridica, filosofica e storica che ha presieduto allo sviluppo delle teorie sui diritti fondamentali, nonché la loro contestualizzazione storica nel succedersi delle civiltà e delle culture dell’Occidente.
Abilità: In conseguenza dell’apprendimento degli elementi indicati sopra, lo studente sarà in grado di comporre un quadro generale dello sviluppo del concetto dei diritti dell’uomo e della sua concretizzazione nei diversi contesti storici, come pure di analizzare in modo consapevole il discorso contemporaneo sui diritti fondamentali, le sue criticità e le sue manipolazioni.
Competenze: Lo studente si confronterà con testi antichi e moderni, ne saprà cogliere il nucleo teorico, ne elaborerà critiche e giustificazioni.Knowledge: students will learn the specific juridical, philosophical and historical terminology that has presided over the development of fundamental rights theories, as well as their contextualization within the different civilizations and cultures of the West.Abilities: after having learned the above cited elements, students will be able to compose an overall framework of the development of the concept of rights of man and its materializing into different historical contexts. They will be also able to analyze consciously the present-day discourse on fundamental rights, its critical points and its manipulations.
Competences: students will be able to face with ancient and modern texts, to grasp their theoretical core, and to elaborate critics and justifications to it.- Oggetto:

- concezione e ruolo della schiavitù nel mondo antico, con particolare attenzione alle teorie aristoteliche e stoiche - il diritto canonico e la teologia scolastica nel medioevo: diritti e libertà nella prospettiva della società corporata - il dibattito sul Nuovo Mondo e sullo statuto giuridico degli indiani - processo inquisitorio e tortura giudiziaria nell’Europa moderna - il diritto naturale moderno: Hobbes, Locke, Grozio, Pufendorf - il riconoscimento storico e politico dei diritti nell’uomo nel XVIII secolo. L’Illuminismo e l’”invenzione” dei diritti: Rousseau, Voltaire, Barbeyrac - il dibattito sull’abolizione della schiavitù - i diritti della donna tra XIX e XX secolo - la dichiarazione universale del 1948 e il suo contesto storico- slavery in the ancient world, its conception and role, with special attention to Aristotelian and Stoic theories - canon law and scholastic theology in the Middle Ages: rights and liberties within the scope of a corporate society - the debate on the New World and the juridical status of the Indians - inquisitorial procedure and judicial torture in Early Modern Europe - early modern natural right: Hobbes, Locke, Grotius, Pufendorf - the historical and political acknowledgment of the rights of man in the 18th century.
